Third lawsuit filed against northern Kentucky jail Associated Press FALMOUTH A third inmate lawsuit claiming abuse in the Grant County jail has raised concerns from officials in a neighboring northern Kentucky county that sends its inmates to the lock up. Falmouth businessman Todd A. Cox filed a federal suit Thursday claiming he was assaulted by jail guards after his arrest March 13 on a drunken driving charge. Cox, 36, claims he was attacked by guards after he dropped his coat and belt onto the floor instead of into a plastic bag as instructed. The suit prompted a quick response from Pendleton County officials, including a special Fiscal Court meeting to discuss the matter.

Pendleton County Judge-Executive Henry Bertram said he was concerned about the county's inmates being housed in the jail in neighboring Grant County. Bertram said Pendleton County officials want assurances that the county's inmates will be safe. A $182,500 yearly contract to house Pendleton County inmates in the jail is due to be renewed in July. "If Fiscal Court does not hear those assurances, I don't know they would sign the new contract," Bertram said.

The latest suit contends that Cox was handcuffed, dragged out of range of the jail's video camera and kicked repeatedly while face down on the concrete floor. Cox was then taken to an isolation cell, where for 18 hours he was ridiculed and denied clean clothes or soap, the suit said. Grant County Jailer Steve Kellam has referred all questions about alleged jail misconduct to his attorney, Tom Nienaber, who did not return phone calls from The Cincinnati Enquirer. Two others have filed suits claiming they were abused in the jail. An 18-year-old has claimed he was sexually assaulted in the jail, which led to the indictment of five inmates.

The grand jury declined to indict any guards, despite claims they encouraged the abuse. Another man, John Taylor, said in his suit that guards beat him, then left him without medical care for several days.
